Any advice please?!


Question: my wife was walking home last night from the pub she crossed the road and the kerb stone gave way she fell and has now in need of surgery to repair her fingers she broke 2 fingers and one needs screws and plates in she only had 1 half of larger and is in lots of pain doctor said she will need to stay off work for around 3 weeks could she make a claim and would this be the local council s fault any advice would great

same thing happened to me the west end pendower, photos and any witnesses make sure you've got before you report it to the council, as they will be straight out to repair it and you will have no photo proof, i got 3 1/2 grand, years ago it took 2 years for council to settle on my broken ankle, keep a list of all out of pocket expenses taxis etc,any brief will take your case on good luck

I would for sure get a picture of where she fell and then take it to a lawyer. I think that you would have a pretty good case against the town that you live in. Good luck

Yes she can make a claim up to 3 years after the event. Take photos of her hand and get photocopies of sick notes/prescriptions etc. Wait until after the surgery and give it time to heal properly before making the claim, you're likely to get more that way in terms of compensation for loss of earnings. I'm not sure whether or not she would have a claim - a trip to a local solicitors would be a good idea - see if there is one with a free initial session. Another thing to do immediately is to go and take a photograph of the kerb where it happened - whether or not the Council think it is their fault they should fix it so that no-one else gets hurt, but you need evidence of what it was like when your wife fell.

Yes you should claim from the council not sure how much she will get, but she should get something it could of been worse, so they should take note.

The Highways Dept (local authority) ultimately are the ones that you will need to contact regarding your wife's injury.
Keep to the facts (it is not necessary to tell them about the half of lager !)

You will need proof of injury so write to them, giving dates and times, send photos of the kerb-stone, showing the 'drop' from the actual pavement, and photos of your wife's injury, medical procedures/name of hospital/consultant name/G.P/ and if possible any statements (if the pavement is outside a shop or home, ask the person how long has this kerb been in this condition, and would they provide a short signed statement for you).

With regard to financial loss, a 'loss of earnings' for your wife needs to be worked out whilst she's been off work and recuperating, plus the same for yourself, if you have had to have time off, to look after her, so ask her employees for a financial statement.

A half hour solicitors consultation may help just to make sure you've covered all basis.

And don't forget to copy everything, photos, letters, statements etc (for your own file) and make a note of dates/times/details (name) and conversation if you telephone the authority or they phone you.
