Question:

Is it right they have sacked me?

I have been working for a company since september 06 and have been kept on probation all this time, when i was signed off sick for 2 weeks in january due to a blood clot in my lung, since then i have been signed off since the start of may due to unknown cause for vomiting - i cannot keep food or water down.

The doctor cannot admit me to hosptal as my weight has not significantly dropped.

I have not been receiving company sick pay.

I received a letter today informing i was fired. Can they really do this to me?

I was never asked to attend a disinaplinary hearing or ever received any type of verbal or written warning.


Answers:

No, absolutely not - you cannot be fired whilst on sick leave, this is discrimination.
If the company wanted to get rid of you then they need to contact you to go though the 3 step discipline procedure. If you are on sick leave you have to be agreeable to come into a meeting.
The only way would be for the company to declare that your post no longer exists but they must be able to prove this
Go onto the ACAS website, very helpful. There are also contact numbers on their who you can call to discuss you circumstances and they will let you know your rights.
